Two scenarios you must understand.

EB-5 is a regulated capital-at-risk program. The mechanics of fund recovery are explicit. Below is the policy framework that governs adverse outcomes.

Scenario A · Petition Denial

If your I-526E is denied by USCIS.

The full $800,000 principal is returned to you at the conclusion of the project's investment cycle. The Regional Center administrative fee and immigration legal fees, however, are not refundable as services have already been rendered.

Scenario B · Job Creation Shortfall

If the project fails to create the 10 required jobs.

Capital is typically returned based on the project's financial lifecycle (stabilization or refinancing), generally 4–5 years. Once returned, your Permanent Green Card status remains fully secure.

Does one investment cover my entire family?

Yes. A single $800,000 investment grants US Green Cards to the principal, their legally married spouse, and unmarried children under 21. Extended family members require separate filings.

Can I apply if I currently reside in the US?

Absolutely. If you hold a valid F-1 or H-1B, you can file for Concurrent Adjustment of Status, granting EAD work authorization and Advance Parole travel within months — bypassing visa wait times.

What is the process for international applicants?

Applicants outside the US undergo Consular Processing. After I-526E approval, a brief interview at your local US Embassy follows. Conditional Green Card activates upon US entry.

What are the travel restrictions during the application?

Adjusting status within the US requires Advance Parole for international travel. Applying from abroad imposes no new restrictions; standard B1/B2 tourist visas remain valid.
